LOTUS LEGACY RETREAT
GENERAL TERMS AND CONDITIONS

These Terms and Conditions (“Terms”) govern the purchase, participation, and conduct of guests (“Guest” or “You”) in retreat experiences offered by Lotus Legacy Retreat (“Retreat Provider”), a Cambodian-based luxury wellness retreat operating in Ratanakiri and Mundulkiri Provinces. By confirming your booking, you agree to be bound by these Terms in full.
1. BOOKING & CONFIRMATION
1.1 All bookings must be confirmed in writing via the Retreat Provider’s authorised channels.
1.2 Bookings are confirmed upon receipt of a formal written confirmation and deposit payment.
1.3 The Retreat Provider reserves the right to accept or decline any booking at its sole discretion.
2. PAYMENT TERMS
2.1 A deposit of 50% of the total retreat package cost is required to confirm the booking.
2.2 The balance is payable no later than 30 days prior to the scheduled retreat start date.
2.3 Failure to pay on time may result in automatic cancellation of your booking and forfeiture of the deposit.
2.4 Payment arrangements between the Retreat Provider and its authorised suppliers, vendors, or distribution partners may differ from those outlined in these Guest Terms. Such arrangements are governed by separate contracts and shall remain strictly confidential between the relevant parties.
3. CANCELLATION & REFUND POLICY
3.1 Cancellations received more than 60 days before retreat commencement will incur a 10% cancellation fee.
3.2 Cancellations received between 30–59 days prior will incur a 25% cancellation fee.
3.3 Cancellations received less than 30 days before the retreat are non-refundable.
3.4 No refunds will be issued for early departures, non-arrivals, or unused portions of the retreat.
4. TRAVEL AND HEALTH RESPONSIBILITY
4.1 Guests are responsible for arranging and securing valid travel documents, visas, vaccinations, and insurance.
4.2 Guests participate in all retreat activities at their own risk.
4.3 By confirming a booking, Guests confirm they are in sufficient physical and mental condition to participate in the retreat activities.
4.4 Guests must disclose any known allergies, medical conditions, or limitations prior to arrival.
4.5 The Retreat Provider assumes no responsibility for any costs associated with medical treatment or emergency evacuation.
5. FORCE MAJEURE
5.1 The Retreat Provider is not liable for any failure or delay in performance due to causes beyond its reasonable control, including but not limited to: natural disasters, acts of war, government restrictions, civil unrest, epidemic or pandemic, or transport disruptions.
5.2 In the event of force majeure, the Retreat Provider may offer a deferral or partial credit toward a future retreat but is under no obligation to provide a refund.
6. GUEST CONDUCT
6.1 Guests are expected to behave respectfully and in accordance with local customs, laws, and the retreat ethos.
6.2 The Retreat Provider reserves the right to remove any guest who acts in a manner deemed unsafe, disrespectful, or disruptive, without refund or liability.
6.3 Guests are responsible for any damage caused to retreat property and will be invoiced accordingly.
7. INTELLECTUAL PROPERTY
7.1 All materials, logos, branding, and retreat programming are the exclusive property of the Retreat Provider.
7.2 No guest may reproduce, publish, or distribute any content from the retreat without express written consent.
8. LIMITATION OF LIABILITY
8.1 To the fullest extent permitted by Cambodian law, the Retreat Provider disclaims liability for any injury, loss, damage, or expense incurred by the Guest during or in connection with the retreat.
8.2 The Retreat Provider’s total aggregate liability shall not exceed the amount paid by the Guest for the retreat.
9. GOVERNING LAW & DISPUTES
9.1 These Terms are governed by and construed in accordance with the laws of the Kingdom of Cambodia.
9.2 Any disputes arising shall be resolved by negotiation in good faith, failing which the dispute shall be referred to arbitration in Phnom Penh.
10. ACCEPTANCE
By submitting payment and confirming a booking, you acknowledge that you have read, understood, and agreed to these Terms and Conditions in full.
